TERMS AND CONDITIONS for the L'Oréal Paris Age Perfect CPD 50 over 50 Gallery Photoshoot competition

Once Osborne Clarke confirm these terms and conditions are in final form and ready for use, you will need to ensure all square brackets and comment boxes are removed from the document.

  • The "Minimum T&Cs" below must be displayed wherever the promotion is promoted.
  • The "Full T&Cs" below must be displayed in their entirety on your site prior to the launch of the promotion.

Minimum T&Cs

Open only to employees of L’Oréal UK Limited working in the Consumer Products Division. Entrants (and/or their nominees) must be resident in England, woman, aged 50+; available to attend a photoshoot in London on 20 or 21 February between 08:30 and 18:30 (the "Photoshoot") and willing to sign the model release form here [https://www.loreal-paris.co.uk/fifty-over-fifty-terms-and-conditions] granting the Promoter the right to use your image and likeness in connection with the Exhibition (defined below). If you are nominating an individual, they must be known to you personally. For your chance to win, email lauriane.flais@loreal.com & finley.collett@loreal.com with the following details: (1) If you are entering the Competition yourself: your name, age, a statement describing your "See me as" perspective; a brief explanation (2-3 sentences) of why you should be chosen, and a digital photograph of yourself (in a PNG, JPEG or PDF format); or (2) If you are nominating an individual to attend the Photoshoot: your name; your nominee's name, age and email address; a statement describing your nominee's "See Me As" perspective; a brief explanation (2-3 sentences) of why your nominee should be chosen; a digital photograph of your nominee (in a PNG, JPEG or PDF format), and confirmation that you have received your nominee's consent and approval to nominate them for the Competition. Entrants can enter themselves once and/or nominate one individual to enter into the Competition. Entries will be judged by a panel of experts on 14 February 2025 and 25 winners will each receive the opportunity to attend the Photoshoot and for their resulting photo to appear in a gallery exhibition in March or April 2025 in London (the "Exhibition"). The prize includes (a) one return train ticket (standard class) from the train station closest to the winner's address in England to the Photoshoot location in London; and (b) one ticket to the Exhibition. Terms and Conditions for the L'Oréal Paris Age Perfect CPD 50 over 50 Gallery Photoshoot competition

By entering the promotion, you agree to be bound by these terms and conditions (these "Terms and Conditions").  Promotional materials relating to the promotion, including all information on how to enter the promotion, also form part of these Terms and Conditions. In the event of any conflict between any terms referred to in such promotion materials and these Terms and Conditions, these Terms and Conditions take precedence.

Eligibility:

  • Entrants must be an employee of L’Oréal UK Limited, working in the Consumer Products Division (CPD) on a full-time or part-time basis;
  • Entrants and/or the individuals nominated by the entrants must be;
       (a)resident in England;
       (b)woman;
       (c)aged 50+;
       (d)available to attend a photoshoot at Gateway West, 189 Wood Lane, London, W12 7SD (the "Photoshoot") on either (i) 20 February 2025 between 08:30 and 18:30; or (ii) 21 February 2025 between 08:30 and 18:30; and
       (e)be willing to sign a model release form granting the Promoter the right to use their image and likeness in connection with the Exhibition. Model release form will be sent upon confirmation  of your participation by finle.collett@loreal.com
  • The individual nominated by an entrant must also be known personally to the entrant.

How To Enter Requirements:

  • Enter by emailing lauriane.flais@loreal.com & finley.collett@loreal.com and providing the following information:
       (a)If you are entering the Competition yourself:
          (i)your full name;
          (ii)your age;
          (iii)"See Me As" statement (see description below);
          (iv)a brief explanation (2-3 sentences) of why you should win the Competition; and
          (v)a digital photograph of yourself (in a PNG, JPEG or PDF format).
       (b)If you are nominating an individual to enter the Competition, such individual must meet the eligibility criteria set out above (i.e. they must be known to the entrant personally, resident in England, woman, aged 50+ and available to attend the Photoshoot on either (i) 20 February 2025 between 08:30 and 18:30; or (ii) 21 February 2025 between 08:30 and 18:30. If you are nominating an individual to enter the Competition, you must provide the following information:
          (i)your full name;
          (ii)your nominee's full name, age and email address;
          (iii)nominee's "See Me As" statement (see description below);
          (iv)a brief explanation (2-3 sentences) of why your nominee should win the Competition;
          (v)a digital photograph of your nominee (in a PNG, JPEG or PDF format); and
          (vi)confirmation that you have received your nominee's consent and approval to nominate them for the Competition.
  • The "See Me As" statement should be a short reflective statement that starts with "See me as" and includes details on what makes you/your nominee unique, special and/or powerful. Such statement can relate to specific achievements in your/your nominee's career/personal life, or reference to your/your nominee's personality.
  • Entrants can:
       (a)enter themselves once in the Competition; and/or
       (b)nominate up to 5 individuals to enter into the Competition.

Major prize:
The winners will win:

  • The opportunity to attend the Photoshoot at the Photoshoot location at a time agreed with the Promoter either on (i) 20 February 2025 between 08:30 and 18:30; or (ii) 21 February 2025 between 08:30 and 18:30, and for the resulting photo to appear in a gallery exhibition in London in March or April 2025 at 40 Earlham St, London, WC2H 9LH (the "Exhibition"). The prize includes:
      o  A return train journey (standard class) from the train station closest to the winner's address in England to the Photoshoot location (such train ticket will be booked by the Promoter on the winner's behalf);
      o  Hair and make-up touch-ups at the Photoshoot (winners should arrive ready to be photographed and will be required to wear their own clothes and accessories and to have done their own hair and make-up in advance);
      o  A 20-30 minute photography shoot with a photographer of the Promoter's choice; and
      o  One ticket to the Exhibition showcasing the winner's photograph, on a date of the Promoter's choosing.
  • Prior to the Photoshoot, each winner will be required to sign a model release form granting the Promoter the right to use their image and likeness in connection with the Exhibition. Model release form will be sent by finley.collett@loreal.com upon confirmation of your participation.

Competition Details

Judging Date: 14 February 2025

Judging Procedure:

Entries will be assessed by a panel of judges (which includes at least one independent judge) based on the following criteria: strength and uniqueness of their entry in comparison to other applicants, and workforce diversity so that the final collection of images showcases a diverse range of ethnicities, skin tones and backgrounds) (the "Judging Criteria"). 25 winners will be selected on the Judging Date.

Notification of Winners:

  • Winners will be notified via the email provided upon entry by 17 February 2025.
  • If a winner does not respond to the Promotor within 2 days of being notified of their winning entry to provide the details requested, the Promotor reserves the right to withdraw the prize and offer it to an alternative entrant based on the Judging Criteria from all eligible entrants to the Competition.

Delivery

Prize Delivery: Please allow up to 30 days from the date a winner supplies the requested details for delivery of the Exhibition ticket.

General Terms and Conditions

Entry and eligibility
   1.Entries must be received between the Entry Open Date and the Entry Closing Date.
   2.The Competition is free to enter and no purchase is necessary.
   3.Incomplete, illegal, misdirected or late entries will not be valid. Proof of complying with the How to Enter Requirements will not be accepted as proof of receipt or entry. Promoter is not responsible for entries lost, damaged or delayed due to technical or connectivity or other problems.
   4.Only one entry per person (which can include one entry themselves and/or one nominated entry for another individual). Bulk entries from trade, consumer groups or third parties will not be valid. Multiple entries made by the same person from various email, social media or other accounts or from the same IP address will not be valid.
   5.Any entries which do not comply with the How to Enter Requirements, or which contain any third party intellectual property without prior informed consent from the rights holder, or which violates or infringes another’s rights, including but not limited to privacy, publicity, or which contain any abusive, inappropriate, offensive or obscene language or imagery will be disqualified. Examples of language/images considered to be inappropriate, offensive or obscene, include (but are not limited to) any message/image which contains: (a) swearing; (b) comments or actions which appear to be discriminatory of any person, company or group of individuals, for example comments of a racist, sexist or homophobic nature; (c) comments or actions which promote bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age (d) sexual innuendo, sexual language or sexual acts, actions or gestures; (e) promoting any illegal unlawful activity such as drug use; (f) content which is tortious, defamatory, slanderous or libellous; (g) any message that appears to be an advertisement or solicitation to buy; and (h) any materials (whether written or visual) that directly or indirectly relate to Promoter’s competitor brands or that show any intention of promoting any brand other than Promoter brand.
   6.The Promoter reserves the right to require entrants and nominees to prove that they are eligible to enter the Competition and/or to carry out its own investigations (either itself or through a third party acting on its behalf) to verify that entrants/nominees have satisfied the Eligibility and How to Enter requirements. If a winner is found to be ineligible, the Promoter reserves the right to select, based on the Judging Criteria, an alternative winner from all other eligible entrants to receive their prize.

Prize fulfilment and disqualification
   7.Prizes are as stated, they are not transferable and there are no alternative prizes or cash substitutes. Promoter reserves the right to substitute a prize of equal or greater value in the event that the selected prize is unavailable for any reason whatsoever.
   8.A winner forfeits their prize and the Promoter reserves the right to select an alternative winner based on the Judging Criteria if:
      (a)within 2 days of being notified by the Promoter, a winner does not respond or does not provide relevant details (if applicable, details for the prize to be despatched to in the eligible country of residence); or
      (b)if a prize is rejected or returned undeliverable; or
      (c)if an entry is invalid or an entrant is disqualified or in breach of these Terms and Conditions.
   9.Promoter reserves the right to disqualify an entrant or winner that in its absolute discretion could bring the Promoter into disrepute.
   10.Promoter shall disqualify any entries that have failed to abide by and/or are in breach of these Terms and Conditions.
   11.Promoter must either publish or make available information that indicates that a valid award for the Competition took place. Promoter may therefore use the winner's surname and county of residence to announce them as the winner of the Competition. If you do not wish for your personal information to be used for this purpose or, if you wish to limit the amount of personal information that is published, please email lauriane.flais@loreal.com & finley.collett@loreal.com upon entry to the Competition. In such circumstances, the Promoter must still provide such information and all winning entries to the Advertising Standards Authority on request
   12.The name of the winners can be obtained by sending a stamped, self-addressed envelope, within 4 weeks of the Judging Date to the Promoter at Gateway Central, White City Place, 187 Wood Lane, London, W12 7SA, referencing the Competition Name.

Conditions of travel
   13.The winner must provide the Promoter will their preferred Photoshoot date and time no later that 14/02/2025.
   14.The prize includes one return train journey (standard class) from the train station closest to the winner's address in England (inclusive of all applicable rail taxes, fees and duties) to London for one person. Train tickets must be booked by the Promoter no later than 17/02/2024 Train journeys may be indirect and the journey itinerary will be selected by the Promoter at their sole discretion. [Once issued, train tickets cannot be re-issued and date or routing changes are not permitted.] Train ticket booking terms and conditions for the train journey will apply.
   15.Travel will be from the train station closest to the winner's address in England to the Photoshoot location, and vice versa only. Travel from the winner's address in England to the train station closest to the winner's address in England, and from the London train station to the Photoshoot location is excluded.
   16.Prize excludes accommodation, spending money, additional meals, drinks, gratuities, excursions, attractions, treatments, visas, travel insurance, personal expenses, telephone calls and incidental expenses incurred whilst on the prize trip, other than those stated as included. For the avoidance of doubt, costs associated with attendance at the Exhibition (including travel to and from the Exhibition) is excluded.

Promotional Activity relating to the Competition
   17.In entering the Competition, all entrants and winners agree to participate in any promotional activity relating to the Competition, which may include entry content, voice, image and name for publicity purposes (in any media, print or online, including any websites, social media sites or third party retailer websites) and in advertising, marketing or promotional material (whether or not related to the Competition) free of charge without additional compensation or prior notice. Promoter may modify any entry content to fit in context with the relevant usage, whilst maintaining its original sentiment.

Personal Information
   18.All personal details and/or information given either in the entry process or otherwise must be truthful, accurate and in no way misleading. Promoter reserves the right to disqualify entrants if they have supplied untruthful, inaccurate or misleading personal details and/or information.
   19.Any personal information that entrants share with the Promotor (including name, address, email, social media profile, or other data) will be kept secure and only used in line with the Promoter’s Privacy Policy and these Terms and Conditions. By entering the Competition, entrants acknowledge that their information may be used by the Promotor and its suppliers to administer the Competition. The Promotor may contact entrants by email, post, phone, SMS or other means in relation to the Competition, but will not send entrants any marketing communication unless entrants have also agreed to this or the Promoter has another lawful basis for the communication.

Use of Entry Content
   20.By entering the Competition, an entrant:
      (a)confirms they have the right to make available their content as is required by the Competition How to Enter Requirements, including the express consent of anyone else who features in their entry for the Promoter to use their personal data; and
      (b)confirms their entry does not infringe any third party intellectual property rights.
   21.Promoter shall own all the copyright and other intellectual property rights in the entries and any other materials (whether visual, oral or written) generated during the various stages of the Competition, in perpetuity and on a worldwide basis for use at Promoter's sole discretion including, without limitation, use in advertising, other media, press releases, editorial and promotional activity, point of sale material, Promoter's websites, third party websites (including Facebook, Instagram, Twitter and YouTube), newsletters and e-newsletters. Accordingly entrants assign to Promoter any copyright and other intellectual property rights which exist in their participation in the Competition and irrevocably waive any moral rights that could vest in them (which shall include their name, location and age) under the Copyrights, Designs and Patents Act 1988 or otherwise, and undertake to do all things necessary immediately on Promoter’s request to effect or confirm any assignment in this paragraph.

Limitation of Liability
   22.Neither the Promoter nor agencies nor suppliers involved in the Competition may be liable to the winners, whether arising from tort including negligence, breach of contract or otherwise or for any damage, loss, liabilities, injury or disappointment incurred or suffered whatsoever as a result of or relating to participation in the Competition or the prizes unless you suffer personal injury or death as a result of the Promoter's negligence. No compensation for loss of earnings will be paid by the Promoter for participation in any aspect of the Competition.

General Terms
   23.Promoter’s decision is final and no correspondence will be entered into.
   24.Promoter reserves the right in its absolute discretion to amend or waive any of these Terms and Conditions, or suspend or cancel the Competition at any stage, in the event of circumstances that are unforeseen or beyond its reasonable control (including suspected or actual fraudulent or misleading practices or other breaches of these Terms and Conditions).
   25.English law applies and the English courts shall have exclusive jurisdiction over any proceedings in connection with this promotion.
